The present study of G. E. Moore’s common sense philosophy focuses on two issues: in what sense Moore may be said to be a common sense philosopher, and whether he is consistent as a common sense philosopher. The first four chapters are devoted to his conception of philosophy, common sense, and ordinary languages, and the philosophical paradoxes which arise out of these conceptions. Although the readings vary greatly in difficulty a careful selection would make the book useful for introductory courses. An introduction provides a brief survey of analytic philosophy since 1900. We argue that the self-experimentation espoused by Roberts as a means of generating new ideas, particularly in the area of mood, may be confounded by the experimental procedure eliciting those affective changes. We further suggest that ideas might be better generated through contact with a broad range of people, rather than in isolation.

Live donor kidney transplantation is the best treatment option for most patients with late-stage chronic kidney disease; however, the rate of living kidney donation has declined in the United States. A consensus conference was held June 5-6, 2014 to identify best practices and knowledge gaps pertaining to live donor kidney transplantation and living kidney donation. Transplant professionals, patients, and other key stakeholders discussed processes for educating transplant candidates and potential living donors about living kidney donation; efficiencies in the living donor (...) evaluation process; disparities in living donation; and financial and systemic barriers to living donation. We summarize the consensus recommendations for best practices in these educational and clinical domains, future research priorities, and possible public policy initiatives to remove barriers to living kidney donation. Although there is considerable overlap with the approach to adult consultation, ethics consultants must be aware of differences when they work with infant, pediatric, and adolescent cases. This article addresses unique considerations in the pediatric setting, reviews foundational theories on parental authority, suggests practical approaches to pediatric consultation, and outlines current available resources for clinical ethics consultants who wish to deepen their skills in this (...) area. Abstract“Comprehensive Healthcare for America” is a largely single-payer reform proposal that, by applying the insights of behavioral economics, may be able to rally patients and clinicians sufficiently to overcome the opposition of politicians and vested interests to providing all Americans with less complicated and less costly access to needed healthcare.

The COVID-19 pandemic has forced developmental researchers to rethink their traditional research practices. The growing need to study infant development at a distance has shifted our research paradigm to online and digital monitoring of infants and families, using electronic devices, such as smartphones. In this practical guide, we introduce the Experience Sampling Method – a research method to collect data, in the moment, on multiple occasions over time – for examining infant development at a distance. ESM is highly suited for (...) assessing dynamic processes of infant development and family dynamics, such as parent-infant interactions and parenting practices. It can also be used to track highly fluctuating family dynamics and routines. The aim of the current paper was to provide an overview by explaining what ESM is and for what types of research ESM is best suited. Next, we provide a brief step-by-step guide on how to start and run an ESM study, including preregistration, development of a questionnaire, using wearables and other hardware, planning and design considerations, and examples of possible analysis techniques. Finally, we discuss common pitfalls of ESM research and how to avoid them. (shrink)

At Moore’s time, the main-stream ethical theory is the doctrine that pleasure alone is good as an end as held by the hedonistic utilitarianism. Moore, however, asserts that good, not composed of any parts, is a simple notion and indefinable, and naturalistic ethical theories, in particular hedonistic utilitarianism, interpret intrinsic good as a property of a single natural object---pleasure, which is also the sole end of life, thus violates naturalistic fallacy. Moore seems to believe that there exist (...) things other than pleasure that are also intrinsically good and has searched for them. But Moore has not clearly stated what these things are, nor has he given any justification for why they are intrinsically good. This paper discusses Moore’s arguments and difficulties of utilitarianism. With the subjectivistic utilitarian theory of value, Unified Utilitarian Theory (UTT) discards the classification of value into intrinsic and instrumental and proves to be exempt of all theexisting difficulties with utilitarianism related to pleasure, including naturalistic fallacy, vagueness of pleasure and sole end of life, double counting, etc. (shrink)

The principal contemporary moral views are treated under three headings: 1) Intuitionism, represented by G. E. Moore, H. A. Prichard, and W. D. Ross; 2) Emotivism, as expounded by C. L. Stevenson; and 3) Prescriptivism, R. M. Hare's view. Warnock carefully distinguishes the questions these views were designed to answer from the questions which he feels they do in fact answer. Warnock emphasizes throughout the problem of the relation between moral discourse and conduct, as well as the question of (...) the possibility of moral "argument" in the sense of giving "reasons" for a moral viewpoint. In the latter half of the volume Warnock sketches what he takes to be some of the necessary requirements for a more adequate moral theory. He discusses "Naturalism" and rejects the blanket term as misleading unless the precise view one labels "naturalistic" is spelled out. Warnock distinguishes two "anti-naturalist" views: 1) that description and evaluation are different, i.e., that evaluation is not "reducible" to description and 2) that they are logically independent. He considers 1) a platitude. He accepts 2), but rejects what might be considered a further implication of this view—that absolutely anything might be regarded as a criterion of evaluation. In conclusion Warnock suggests that it might be profitable to look for the distinctive features of moral discourse in the content rather than the form. A fluent exposition and critical discussion of some recent thought on the existence of universals, the analysis of a priori statements, and the justification of ethical judgments and decisions, centered on the work of Russell, Moore, and the Positivists. The main criticisms draw heavily upon the author's earlier discussions of synonymity, a weakly articulated notion of explanatory utility, and a fruitful extension of Austin's analysis of performatory utterances. By focusing primarily on communication between adult and child and on adult-set criteria for appropriate action, Carpendale & Lewis's (C&L's) account of the development of social understanding in the epistemic triangle tends toward an enculturation view, while diminishing the role of individuals. What their proposed mechanism fails to acknowledge is that the two agents in the epistemic triangle necessarily have independent perspectives of the object and of each other.

This paper examines the debate as to whether something can have final value in virtue of its relational (i.e., non-intrinsic) properties, or, more briefly put, whether final value must be intrinsic. The paper adopts the perspective of the fitting-attitude analysis (FA analysis) of value, and argues that from this perspective, there is no ground for the requirement that things may have final value only in virtue of their intrinsic properties, but that there might be some grounds for the alternate requirement (...) that final value be grounded only in the essential properties of their bearers. First, the paper introduces the key elements of the FA analysis, and sets aside an obvious but unimportant way in which this analysis makes all final values relational. Second, it discusses some classical counterexamples to the view that final value must be intrinsic. Third, it discusses the relation between final, contributive, and signatory value. Fourth, it examines Zimmerman’s defense of the requirement that final value must be intrinsic on the grounds that final value cannot be derivative. En cela, la figure juridique fait acte politique: elle ne prend pas le contexte auquel elle fait face comme un donné «naturel» qui s’imposerait à elle univoquement, mais elle choisit dans la complexité de ce contexte ce qui lui semble correspondre à l’univers juridique auquel elle appartient. Cela est possible de par sa position même dans chacun des deux univers—c’est sa véritable situation—d’un côté comme fonction juridique et de l’autre, mais en même temps, comme acteur social: elle a à dire ce qui peut passer de l’un à l’autre, elle ne répète pas ce que l’un ou l’autre dit; elle se trouve en situation parce qu’elle est le lieu de passage entre deux mondes non concomitants dans leur existence propre, mais entre lesquels elle a à faire correspondre un discours qui donne et prenne sens. Parler des limites de telles organisations peut s’entendre en deux sens, qui interagissent: premièrement, elles peuvent servir à différencier ces systèmes par rapport à d’autres ordres normatifs. Secondement, elles désignent ce que, par sa texture, le droit est hors d’état de réussir. 2. On comprend le concept de système comme une organisation aux structures différenciées de textes, de normes, d’acteurs. Ce (...) qui caractérise un système est son autoréférentialité et ses modes de clôture et ses modes d’ouverture. 3. Concernant la limite dans le second sens, on observera que la normativité comme mode d’action propre au droit le met souvent dans l’incapacité d’assumer pleinement les tâches de régulation qui lui sont confiées. Il s’agit d’une part d’une limite factuelle: celle de la technicité et du volume de ces tâches. D’autre part, la nécessité de plus en plus fréquente de prendre en compte les circonstances individuelles concrètes de l’application entraîne une légistique de diminution de la densité normative et, par conséquent, de déplacer une épistémologie fondée sur la répétition en direction de l’innovation. 4. Ces deux facteurs notamment font du droit un univers qui ne peut plus prétendre à une complétude cohérente: c’est un univers en constante évolution, qui exige pour sa mise en œuvre, de manière continue, l’apport d’informations provenant de son environnement. Ces apports circulent dans les modes d’ouverture du droit—la diminution de la densité normative et le recours à des expertises, des savoirs, des déontologies extérieures. Cependant, en vertu de l’autoréférentialité du droit, ces apports doivent être sélectionnés et juridicisés pour être intégrés dans le système juridique et préserver ainsi sa clôture. Il y a là une double programmation à respecter: la sélection doit d’une part respecter le cadre normatif du droit et de l’autre porter sur un choix correspondant aux attentes sociales qu’il s’agit de convaincre de son bien-fondé. Les limites du droit par rapport à d’autres ordres normatifs est ainsi définie par l’ordre juridique lui-même, dans le respect de cette double programmation. 5. Ce système a des présupposés politiques, culturels et historiques qui empêchent d’élaborer sans autre une essence du droit, valable urbi et orbi: notamment séparation des pouvoirs et liberté d’expression. Il n’est même pas certain qu’il puisse perdurer. En particulier, l’internalisation croissante du droit n’est guère conciliable avec son organisation telle que l’Occident l’a conçue. En outre, de plus en plus le droit devient l’objet d’une normativité supérieure, au nom de laquelle il est lui-même jugé: c’est le phénomène de l’économisation du droit. (shrink)
